Terms of Service

The rules for using FluxxChat.

These terms apply when you use FluxxChat, a product of Fluxx Tech, Coimbatore, Tamil Nadu, India. By creating an account or using the service you agree to them.

1. The service

FluxxChat lets businesses connect their WhatsApp Business and Instagram accounts through Meta's official APIs to send and receive messages, run campaigns and use automated replies. Features depend on your plan.

2. Your account

  • You must give correct business details and keep your login secure.
  • You are responsible for everything done through your account and your team members' access.
  • You must be authorised to connect the WhatsApp and Instagram accounts you add.

3. Meta platform rules

Your use of WhatsApp and Instagram through FluxxChat must follow Meta's terms and policies, including the WhatsApp Business Terms, WhatsApp Business Messaging Policy, Meta Platform Terms and Instagram policies. Meta may limit, suspend or change access and pricing, and we are not responsible for Meta's decisions.

4. Acceptable use

  • Message only people who have agreed to hear from you, and honour STOP and opt-out requests.
  • Do not send spam, misleading, illegal, hateful or adult content, or anything that breaks the law or Meta's policies.
  • Do not use FluxxChat to collect or sell data about people, or to send messages you are not permitted to send.
  • Do not attempt to break, overload or reverse engineer the service.

We may suspend or end accounts that break these rules or put the platform or other Customers at risk.

5. Fees and wallet

Plans, message charges and taxes are shown on the pricing page and in your dashboard. Message charges include the fees set by Meta. Wallet balance is used to pay for messages, and campaigns pause when the balance runs out. Charges for messages already sent are not refundable, except messages that fail and are automatically credited back.

6. Your data

You own your data. You allow us to process it only to provide the service, as described in our Privacy Policy. You are responsible for having the right to message your contacts.

7. Availability

We work to keep FluxxChat available and secure, but the service depends on Meta and other providers, and we cannot guarantee it will always be uninterrupted or error free.

8. Liability

To the extent allowed by law, FluxxChat is provided "as is" and our total liability for any claim is limited to the fees you paid in the three months before the claim. We are not liable for indirect or lost-profit losses, or for losses caused by Meta's actions or your own content and messaging practices.

9. Ending the service

You can stop using FluxxChat and ask us to delete your data at any time (see Data deletion). We may end or change the service with reasonable notice.

10. Law and contact

These terms are governed by the laws of India, and the courts at Coimbatore, Tamil Nadu have jurisdiction. Questions: hello@fluxxchat.com.
